Terms and Conditions for a Safari with Kabiza Wilderness Safaris – sorry we have rules too. What makes us different that we do our all to work with our clients and their situations. Terms and Conditions come into play every time you sign up with a new service on line as they do with most reputable Safari Tour Operators in Uganda – Rwanda.
Terms and Conditions for a Safari with Kabiza Wilderness Safaris – We have some rules -however, it is the spirit of how we enforce them – That is done with you in mind not our bottom line. There are also rules for you for your protection while going on safari with us.
As a Safari Tour Operator we are in control of things like our driver-guide – the activities and lodges where you will be staying, however we do not control roads, newly broken bridges, the weather, the attitude of employees at accommodations. Your Tour-Guide is the one who makes the Safari happen on the ground. Read our Terms and Conditions for Peace of mind.
TERMS AND CONDITIONS – Kabiza Wilderness Safari
GENERAL:
Kabiza Wilderness Safaris organizes private safaris in Uganda and Rwanda. Safaris are organized by Kabiza Wilderness Safaris LTD registered in the Republic of Uganda. Please read the Terms and Conditions and the Travel information for specific countries carefully as together they set out our respective obligations and form the basis of your contract with us.
In these terms and conditions, “you” means all persons named on the booking (including anyone who is added or substituted at a later date) and “we” and “us” means Kabiza Wilderness Safaris. These terms are amended from time to time due to changing circumstances; the terms at the time of booking are the terms that are valid.
Conditions in Africa are not the same as those in developed countries and standards of services, medical facilities, safety and security may often be lower than those in your home countries. Please note that it is the laws and regulations of the country in which services are provided which apply to your holiday arrangements and not those of your home country.
INFORMATION ACCURACY:
The itinerary given containing the descriptions, information regarding the national parks, the animals you might see while in a particular park, the accommodations that you chose for your safari, gorilla permits, chimpanzee permits, the present security and health condition inUganda and or Rwanda are all given based on the latest information and in good faith.
We have taken painstaking care to ensure that our information is the latest and accurate. Everything has been done to ensure what we have stated to you is accurate in nature.
We however cannot accept responsibility or liability for any errors or omissions caused by matters beyond our control. We will keep you updated of any changes and make them with your approval. Our safaris are often not based on tour packages as such but based on your wishes and input regarding lodging, activities, parks and places to visit.
Acceptance of booking for a Safari with Kabiza Wilderness Safari
The contact person (‘head of group’) who signifies his/her acceptance of a booking does so on behalf of persons under his/her authority, which means that all group members represented by the Contact Person are equally bound by these terms and conditions.
Deposit for a Safari with Kabiza Wilderness Safaris
To secure a booking, a non-refundable deposit is required which shall be the sum of 20% of the Safari arrangement costs, plus the full amount for the gorilla permits (US$ 600 per permit – Habituation Experience 1500 USD), the chimpanzee permits per person (US$ 150- Habituation US$ 220), and all in country Airplane Tickets for a Flying Safari (if needed) for each person in the group.
Full payment for Safari Booked:
The full amount owed by the client to Kabiza Wilderness Safaris shall be payable not less thanfive weeks prior to the beginning date of the Safari. If the full amount is not paid in due time, the company reserves the right to treat the booking as cancelled.
Kabiza Wilderness Safari will not be held responsible for price changes or over-bookings in the time between booking and receiving the deposit.
Bookings made within six weeks or less from the departure date must be paid in full immediately. Payments can be made by bank transfer to our Barclay Bank Account in Uanda. Transfer costs are to be paid by the client(s).
Payments with credit or debit card can be made after you receive an Invoice from us using the online PesaPal Service for which there is a 3.5% service charge paid by you or in Uganda using Barclay Merchant Services in our office where we accept Visa, MC, AEX – a 5% service charge is added to amount owed to us.
Cancellation by Kabiza Wilderness Safaris.
The company reserves the right to cancel a safari or any part of it for any of the following reasons:
- If the company or its supplier(s) regard adverse weather conditions or other safety concerns as unacceptable and which cannot reasonably be overcome.
- If the company reasonably believes that you may cause harm or damage to its reputation or to the reputation of its suppliers or to property belonging to its suppliers.
- If a company supplier or suppliers is/are unable to host its portion of the Safari for any reason.
- If changes you wish to make to the Safari Itinerary makes it is uneconomical or impractical.
Should Kabiza Wilderness Safaris cancel a Safari, it shall be rescheduled for a mutually convenient date, or a refund shall be provided to the client.
Kabiza Wilderness Safaris shall be under no further liability to the client for cancellation of the event or any part of it. If, due to reasons beyond our control, an event is unable to take place due (but not limited) to the closure of premises, the ceasing of trading, or a change in supplier’s management, the company will provide the client with an alternative itinerary and if this does not prove possible, shall refund the refundable portion of the Safari.
We reserve the right, to terminate the holiday of any person in your party if, in our opinion or in the opinion of any other person in authority, the persons concerned behave in such a way to cause or be likely to cause danger, annoyance or distress to any third party or damage to property. In this situation, the person’s) concerned will be required to leave the accommodation or other service immediately. We shall have no further responsibility towards such person’s). No refunds will be made and we shall not pay any expenses or costs incurred as a result of the termination
Cancellation by client(s)
The cancellation of a booking by the Client must be made in writing and signed by the group contact person. The amount of the cancellation fee is calculated according to the date on which Kabiza Wilderness Safaris receives the written cancellation notice:
- 29 days or more before the departure date, the cancellation fee is 60% of the land arrangement plus the full cost of gorilla permits, chimpanzee permits, and in-country flight portions
- 28 to 14 days before the departure date, the cancellation fee is 75% of the total cost of the booking plus the full cost of gorilla permits, chimpanzee permits, and in-country flight portions
- 13 to 7 days before the departure date, the cancellation fee is 90% of the total cost of the booking plus the costs of gorilla permits, chimpanzee permits, and in-country flight portions.
- Within 1 week of the departure date, the cancellation fee is 100%.
- Cancellation before the deposit has been made will not incur any fees
Cancellation, Medical and repatriation insurance is Highly suggested for our clients, and it is the client’s responsibility to arrange such insurance through the client’s broker. It is strongly recommended that clients also take out to cover emergency travel and accommodation, lost baggage and any other cover the clients deem fit. The decision of which insurance cover he/she obtains is solely the responsibility of the client.
Permit Refunds:
Refunds of Gorilla – Chimpanzee – Golden Monkey Permits depend on our ability to resell them to another tour operator for the dates on them. We have a service charge in case that we need to resell the permits.
Safari Itinerary Changes made by Client(s)
The company shall do their best try to accommodate any reasonable changes the client wishes to make to the Safari. Alterations and amendment requests should be made with the company and not with end suppliers.
Such requests should be made in writing to the company by the group contact person. These changes shall not be deemed accepted until confirmed in writing by the company by sending a revised itinerary.
If the client wishes to increase or decrease the number of persons participating in the event, this may be done up to six weeks prior to the date upon which your event is due to start without additional charge. The safari cost per person will be adjusted accordingly
Subject to the company’s written agreement, the client may transfer a booking to a person who satisfies all the conditions applicable to the activities in the itinerary.
Changes made to Safari Itinerary by Kabiza Wilderness Safari
When requested accommodation is fully booked or otherwise unavailable, the company reserves the right to change the accommodation to an accommodation of the same standard in the same area. Such changes must be communicated to the client.
Acommodation changes may affect the price of a safari since prices vary between accommodations.
Safari Price Increases
Safari Prce increases may occur due to any increase in-country flying safari rates, fuel costs, game reserve fees, permit price increases and fluctuation of exchange rates. The company reserves the right to modify the cost per person and add a surcharge. Should any clients refuse to accept and pay such surcharge, the company reserves the right to cancel the tour and make refunds of down-payments except upon reselling the permit, and attempt to receive lodging refunds, minus our cost incurred which would be minimal.
ACCOMMODATIONS:
We allow you to choose the accommodations that you desire, we will recommend the ones that we feel are best for you based on the price range you have requested. The prices are based on two persons sharing a double or twin room. In all cases we provide full board accommodations while on Safari-except in instances where it is outlined in the itinerary and agreed on by you. Single travelers that are part of the safari will have to pay a single supplement.
CLIENTS’ COMPLAINTS:
If you have any complaints please let your driver-guide – your satisfaction is most important to us. Our driver-guide will do his best to resolve any complaints. We will do our best to resolve them. If your complaints were not resolved submit a written report to Kabiza Wilderness Safaris as soon as possible. Please do so no later than 20 days after your safari. It is however best that any issues are resolved before the ending date of your safari. We will try to rectify problems as soon as they arise.
FORCE MAJEURE:
We regret we cannot accept liability or pay compensation where the performance or proper performance of our obligations is prevented or affected by any event which we or the supplier of the service’s) such as lodgings in question could not, even with all due care, foresee or avoid. Such events include war or threat of war, riots, civil strife, border closures, unexpected government acts, terrorist activity, industrial disputes, a natural disaster, extreme weather conditions, fire, road closures, pilferage, epidemics, quarantines, dangers incident to sea, land and air travel, and other similar acts or incidents beyond our ability to control.
Certain activities that you have chosen as part of your itinerary have a certain of risk of personal injury. Activities, but not limited to, such as Hiking, Mountain and Volcano climbing, boat rides, canoeing, white water rafting trips, etc.
You should be aware that your personal safety cannot be guaranteed. Should you elect to participate in such activities while you are on tour, you are, of course, free to do so. However, you must understand that such participation will be at your own risk and that we assume no responsibility for your safety..
INSURANCE:
It is advisable that before undertaking a safari with us that you have, appropriate insurance for the type of holiday being taken. Such insurance should fully cover death, personal injury, medical expenses, repatriation in the event of accident or illness or death, cancellation or curtailment of the holiday by side and loss of, damage to, or theft of the clients’ personal property. Activities with a greater inherent risk, such as mountaineering, animal tracking on foot, horse back riding safari, ATV Safaris, white-water rafting should be covered.
MEDICAL REQUIREMENTS:
Good physical and mental health is essential for the enjoyment of these active, outdoors tours. You may travel in rugged areas removed from modern medical facilities. Good physical conditioning is recommended as preparation for all tours, especially those involving Gorilla Tracking, Mountaineering, Chimpanzee Tracking, Volcano Climbing.
By booking a safari, the client certifies that he/she does not have any physical or other condition of disability that would create a hazard for him/herself or other participants. It is essential that any participant with a medical condition requiring regular treatment or which may be affected by vigorous activity, high altitude, heat, cold, other natural phenomenon, or particular foods, notifies Kabiza Wilderness Safari in writing in advance of travel so that we can make the appropriate arrangements.
We assume no liability for medical care nor for special dietary requirements if not informed long in advance. The medical requirements by some places like Ngamba Chimpanzee Sanctuary Island is a sole responsibility of the client to meet them. We will send you the medical requirements should you include it in your itinerary.
It is also recommended that you take all precautions for traveling in Africa and receive suggest and required immunizations from a tropical clinic or your family doctor. A malaria regiment of some kind is also strongly suggested.
JURISDICTION:
The principal company is incorporated in the Republic of Uganda and it operates under the laws of Uganda. Your contract with us and matters arising out of it will be governed by the laws of Uganda save for contracts made through our associated agents abroad or in any other country, which will be governed by the laws of those countries.
LIABILITY:
We shall make every reasonable effort to ensure that every portion of your planned itinerary is followed by us as described and agreed to by you with the best standard possible.
Our employees, agents, suppliers, and sub-contractors exercise due care in carrying out our obligations under the contract. We accept responsibility for what our employees, agents, suppliers, and sub-contractors do or do not do (provided they were at the time carrying out work authorized by us). I
f any part of your Safari activity is not provided for we shall pay you appropriate compensation if your enjoyment of the holiday has been affected and you have followed the complaints procedure set out in these terms and conditions.
This acceptance of responsibility is subject to the clause relating to “Force Majeure” above and these Terms and Conditions generally. Our maximum liability in respect of complaints (except where death, personal injury or illness results, or where claims relate to loss or damage to possessions or luggage, which are dealt with below) is limited to an amount equal to the cost paid by or on behalf of the person affected for the relevant services such as a missed game drive, boat safari, etc.
We will take all due care to prevent your death, injury or illness is caused by the animal or insect life of the destinations. It is your responsibility to take proper medical and practical precautions in this regard and your attention is drawn to the section in the Travel information relating to Health. Medical advice should be sought well before traveling. Subject to these Terms and Conditions, we accept responsibility should you or any of your party suffer death, personal injury or illness as a result of any failure to perform or improper performance of the contract by any of our employees, agents, suppliers or sub-contractors (provided they were at the time carrying out work authorized by us) except in the following situations.
We will not be liable where any failure to perform or improper performance was due to:
1.The acts or omissions of a third party not connected with the provision of the Safari under the contract and which were unforeseeable or unavoidable.
2.An event which we or the supplier of the relevant services could not have foreseen or avoided even with all due care. Any claim must be notified to us in accordance with the complaints procedure set out above. Any person to whom any payment is made (and their parent or guardian if that person is a minor) must assign to us and our insurers any rights they may have to pursue any third party in connection with the claim and provide all necessary assistance to us and our insurers that be reasonably required.
QUOTATIONS, BOOKINGS & PRICES:
Please ensure that the quotation given with details of number of clients, dates, accommodation, transportation, permits, park fees and all other services to be provided is clear and accurate before confirming the booking in writing. All references to quotations in writing shall include reference to correspondence by facsimile and electronic mail. The price of your safari will be confirmed at the time of booking. We reserve the right to correct errors in both advertised and confirmed prices and will do so as soon as we become aware of any such error.
SAFARI TERMS:
Prices include airport transfers, accommodation, meals as stated, the services of an English-speaking driver/guide and a safari vehicle, two items of luggage per person plus carry on, boat trips, park fees, gorilla and chimpanzee permits where appropriate.
Prices exclude all items of a personal nature such as entry visas, insurance, tips, telephone calls, laundry, gifts, airport taxes and all drinks. In Kampala, Entebbe or Kigali the prices include bed and breakfast only unless otherwise stated in your itinerary. On safari the prices cover full board. The company reserves the right to vary the safari services agreed with the client in the event of unforeseen circumstances, such as road closures, bad weather, problems with national parks or hotels, security considerations. In such cases alternative arrangements will be made as the situation permit.
Safari Price Increases
Safari Price increases may occur due to any increase in – Flying Safari Tariffs, fuel costs, game reserve fees, or fluctuation of exchange rates, Lodging Price Increases, new Taxes. The company reserves the right to modify the fare and add a surcharge. Should any clients refuse to accept and pay such surcharge, the company reserves the right to cancel the tour and retain full payment.
TRANSPORTATION:
Every effort is made to ensure that vehicles are provided in a roadworthy condition but no liability can be accepted for breakdown, or any damage or delay.
Our guides are trained as how to handle various situations that may arise and will do everything to provide for your well being. In the case the driver guide is not fulfilling the promised services please notify our office and request the guide to call our safari manager in Kampala.
Company vehicles must only be driven by our guide whose decision on all matters, such as the route taken, is final. You will be liable for any damage caused to a vehicle by any interference by you with the vehicle, including legal cost.
In case of a breakdown, it’s our responsibility to rectify the situation. We can either replace the vehicle that has broken down or if the breakdown is minor and can be repaired in a reasonable time, we reserve the right to do so.
Client Responsibility
The client acknowledges that it is solely his/her responsibility to ensure that he/she is in possession of the necessary travel documents that may be required in respect of the proposed tour and itinerary as well as all health and other certificates that may be required.
Travel Insurance is a must for those going on Safari with Kabiza Wilderness Safaris. We do not sell it, but we strongly recommend it.
Special Requests
Clients who have special requests must specify such requests to the company in the booking reservation form. Whilst the company will always endeavor to accommodate such requests, it does not guarantee that it will always be possible.
Though we have terms of service and legal language our aim is to create a memorable time in Uganda and Rwanda on Safari and we normally succeed at that in a mutually satisfying manner…Enjoy your African Safari with us.

Terms of Service – a lot of words protecting both you and Kabiza Wilderness Safaris. Our actions over the years speak louder than words written above. Our commitment is to work with you and providea memorable Safari for you.
The Terms of Service are rarely referred by us or out clients. Our Commitment is to serve you in a manner that puts you first and us second. The reason that we rarely refer to the above.
For peace of mind, we strongly suggest Travel Insurance, something our clients have had to rarely use, but when they did, they wer glad that they had taken out the Insurance that covered their Safari.
